Welcome to Scope.LK. These Terms and Conditions ("Terms") govern your use of our website, our onboarding form, and the web design, development, hosting, and support services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services.
01Services Provided
Scope.LK is a Sri Lankan web design and development studio offering bespoke website design, custom development, dedicated hosting, domain registration, ongoing maintenance, and technical support for businesses of all sizes. The exact scope of services for each engagement is agreed upon in writing (via email or WhatsApp) before work begins.
02Eligibility & Use of Website
You must be at least 18 years old and legally capable of entering into binding agreements to use our services. By using our website, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the website. You must not use our website to transmit malicious code, spam, or any unlawful material.
03Pricing & Payment
Website Development Pricing
Pricing is unique to each website and is determined entirely by a custom written quotation, based on the project's scope, features, and complexity (for example, marketing sites, ecommerce stores, booking systems, membership portals, or native mobile apps). There is no fixed published price — the final amount for any given project is whatever is agreed in that project's written quotation. The initial quotation also includes your first month of hosting and the project onboarding fee, so the figure you accept covers everything needed to get the site built and live.
First-month hosting is billed together with the initial quotation. The fee for your first month of hosting is included in the initial payment — not invoiced separately — so your site is live from day one with no extra charge at launch.
Payment schedule for the initial quotation. Depending on the project, we may invoice either the full quoted amount at the start, or half of the quoted amount upfront with the remaining half charged during the development period at an agreed milestone. The exact schedule is confirmed in writing in your quotation before work begins.
Ongoing Hosting & Maintenance
Dedicated hosting, server maintenance, SSL, website security, and ongoing website maintenance are arranged privately with each client and confirmed in writing. Pricing and terms for these services are not published publicly and are discussed directly with you based on your project's requirements.
Hosting rates may be adjusted over time in line with updated provider, infrastructure, or exchange-rate costs. Any change to your ongoing monthly hosting rate will be communicated in writing at least 30 days before it takes effect, giving you a fair window to review the new rate or cancel the subscription under Section 05 if you prefer.
Custom Project Pricing
Custom features beyond the standard package — such as e-commerce systems, booking platforms, custom integrations, or membership portals — are quoted separately based on scope. All custom quotes are provided in writing and must be agreed upon before work begins.
New improvement requests after launch are quotation-based. Any new features, design changes, or additions you request once your site is live are priced separately at reasonable rates, based on the work involved. You can discuss these improvements directly with the developer on WhatsApp — share what you have in mind, and we will send back a written quotation before any work starts.
Payment Processing
We currently issue all invoices via bank transfer requests. Each invoice includes our bank account details, a unique reference number, and the amount payable. Website development begins only after the initial payment set out in your quotation has cleared into our account, and recurring monthly hosting invoices are issued on the same basis each billing cycle.
Before any bank transfer request is sent, you must first accept the terms of your quotation with an initial written agreement. Acceptance is confirmed by email or WhatsApp, and covers the quoted scope of work, the payment schedule, and these Terms. Only after that confirmation do we issue the first invoice and release the bank transfer details.
Late Payments
If a recurring payment fails or is more than 14 days overdue, we reserve the right to suspend hosting and support services until payment is received. We will provide reasonable notice via email and WhatsApp before any suspension takes effect.
04Project Delivery & Timelines
Standard website projects are typically delivered within 2–3 weeks of receiving the signed brief and initial payment. More complex projects may take 4–6 weeks. The exact timeline is communicated in writing for each engagement. Delays caused by the client (such as slow feedback, missing content, or unclear requirements) may extend the delivery window.
05Refunds & Cancellations
Before Development Begins
If you decide to cancel within 24 hours of payment and before development work has begun, you are entitled to a full refund less any non-refundable third-party costs already incurred (such as domain registration fees).
After Development Begins
Once development has started, the initial setup fee is non-refundable as it covers design, development time, and resource allocation. Refunds for partially completed work are considered on a case-by-case basis at our discretion.
Quotation-Based Services
All services delivered under a custom written quotation — including bespoke website builds, custom features, integrations, migrations, and any other scoped work priced on a per-project basis — are strictly non-refundable once the quotation has been accepted and payment has been received. Quoted pricing reflects the specific design, engineering, and resource commitments reserved for your project, and those commitments are allocated the moment the quotation is agreed.
Subscription Cancellation
You may cancel your monthly subscription at any time by giving us 30 days' written notice via email or WhatsApp. There are no long-term contracts or cancellation penalties. Once cancelled, hosting and support services will end at the close of the current billing cycle.
If we originally registered your domain on your behalf, a domain transfer fee is payable on cancellation to cover the registrar costs and the administrative work of moving the domain to your preferred provider. A domain you originally supplied yourself remains your property and can be taken with you at no extra charge.
Cancellation does not automatically transfer the website itself. If you would like to take our codebase, custom-built components, images, or any other site content we produced for you to another host or provider, this is a separate matter that must be discussed in writing, and the rates set out in the Site Migration & Code Buyout terms (Section 07) apply — including the minimum 3× transfer buyout calculated against our standard rates.
06Intellectual Property
Upon receipt of full payment, you (the client) own the final design and content of your website. Scope.LK retains the rights to any underlying frameworks, libraries, code patterns, and proprietary tools we use across multiple projects. The compiled codebase, deployment setup, and environment configuration of your site remain part of our hosted service — if you wish to take them with you to another host, please refer to Section 07 (Site Migration & Code Buyout). We may include a small "Designed by Scope.LK" credit in the footer of your website unless you explicitly request its removal.
All content you provide to us (logos, images, text, brand assets) remains your property. You warrant that you own or have the right to use all content you supply and that it does not infringe any third-party rights.
07Site Migration & Code Buyout
Our initial setup and development fees are intentionally offered at a promotional rate. We invest significant design and engineering effort upfront and recover that investment gradually through the ongoing monthly hosting relationship. This arrangement is what allows us to deliver bespoke, custom-coded websites at a price Sri Lankan businesses can realistically afford — and it is only sustainable while the site remains on our hosting.
Our development pricing assumes you continue on our monthly hosting plan. The quoted development rate is approximately one-third of our standard, undiscounted rate. The remaining balance is absorbed by us and recovered gradually through your ongoing hosting subscription — so the discount is earned by the hosting relationship, not granted outside it.
If you later end your monthly hosting plan, or choose to move your website's codebase, custom-built components, or deployment files to another host or company, a one-time transfer buyout becomes payable. Because the price you originally paid reflected our discounted (hosted) rate, the transfer amount is calculated against our standard, undiscounted rate.
Transfer buyout: a minimum of 3× the total amount already invoiced for the build, with everything you have already paid credited against it.
Worked example: if the initial development cost was LKR 20,000 and you added LKR 5,000 in value-added services, the total invoiced is LKR 25,000. The transfer buyout is 3 × LKR 25,000 = LKR 75,000. Because LKR 25,000 has already been paid, the balance owed at the time of transfer is LKR 50,000.
The figures used on any transfer quotation are our standard, publicly undiscounted rates. The lower rates shown on your original invoice are a hosted-customer benefit and are only available while your site is actively hosted with us. The transfer buyout is separate from, and in addition to, any outstanding subscription balance.
Domain transfers are handled separately under Section 05 and are not part of this buyout calculation. If we originally registered your domain on your behalf, a domain transfer fee applies to cover registrar and administrative costs; a domain you originally supplied yourself remains your property and may be taken with you at no extra charge. Likewise, any content you originally supplied to us (logos, text, images, brand assets) is your property and may be exported freely at any time, whether or not a transfer buyout is purchased. Nothing is handed over until the buyout amount has been agreed in writing and settled in full.
08Client Responsibilities
As a client, you agree to:
- Provide accurate, complete, and up-to-date information about your business and project requirements
- Supply all necessary content (text, images, branding) in a timely manner
- Respond to feedback requests and approval points within reasonable timeframes
- Make all agreed payments on time
- Refrain from publishing illegal, offensive, or infringing content on the website we build for you
09Third-Party Services
Our services rely on third-party providers including our banking partners (for payments), domain registrars, hosting infrastructure, and integrated APIs. We are not responsible for outages, downtime, errors, or limitations originating from these third-party services. Your use of any third-party service is also subject to that provider's own terms and policies.
10Limitation of Liability
To the fullest extent permitted by Sri Lankan law, Scope.LK and its proprietor will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, business opportunities, or goodwill — arising out of or in connection with your use of our services. Our total liability for any claim is limited to the amount you have paid us in the 12 months preceding the claim.
11Confidentiality
Both parties agree to keep confidential any non-public information shared during the course of the engagement, including business plans, strategies, financial details, customer data, and proprietary processes. This obligation continues even after our working relationship ends.
12Termination
We reserve the right to suspend or terminate our services immediately, without prior notice, if you breach these Terms, fail to make agreed payments, engage in unlawful activity, or use our services in a way that harms us, our other clients, or third parties. Upon termination, all outstanding fees become immediately payable.
We reserve the right to take a site offline immediately in cases of rejected or disputed payments, or abusive, insulting, or otherwise disrespectful behaviour toward our team. All our quotations are offered at reasonable, fair prices, and we put genuine care into every project. In return, we expect respectful, professional communication — no insults, threats, or personal attacks. This is a baseline expectation on both sides, not a negotiable term.
If hosting is suspended and you wish to take the site elsewhere, Section 07 still applies. Where a suspension or takedown has occurred and you request a transfer of the current site progress to another host or company, the Site Migration & Code Buyout terms in Section 07 — including the minimum 3× transfer buyout calculated against our standard rates — continue to apply in full. Suspension does not waive or reduce the buyout.
During any suspension period, we keep all work produced for your project — codebases, design files, images, logos, and any other materials we created or assembled — securely stored offline and undisclosed to third parties until the dispute is resolved. Nothing is deleted, leaked, or repurposed while matters are in dispute, and nothing is released until any outstanding amounts (or, where applicable, the Section 07 buyout) have been settled.
13Governing Law
These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from or in connection with these Terms or our services will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
14Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. The updated effective date will appear at the top of this page. For active clients, we will provide notice of material changes via email. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
